1. Introductory provisions
These terms and conditions govern the rights and obligations between the operator of the Relicodes.cz online shop, which is BORÁK INDUSTRIES, s.r.o., Company ID (IČO): 08753091, with its registered office at Vlčnovská 2066, 688 01 Uherský Brod, registered in the Commercial Register under file number C 115262 held at the Regional Court in Brno, contact e-mail: info@relicodes.cz, phone: +420 604 647 507 (hereinafter the "Seller"), and the customer who, through the online shop at www.relicodes.cz, orders goods or a related digital service (hereinafter the "Buyer").
The Seller is not a VAT payer. The prices listed on the e-shop are the final prices charged to the customer, unless stated otherwise for a specific offer.
Relicodes is a product intended for the dignified preservation of memories of loved ones. The product consists mainly of a stainless-steel plate with a unique QR code measuring 50 × 55 mm, which links a physical memorial site to a digital memorial profile. The Buyer can manage the content of the profile through the Relicodes mobile application, in particular by uploading photographs, videos and written memories.
These terms and conditions form an integral part of the purchase contract concluded between the Seller and the Buyer. The Buyer has the opportunity to review them before submitting the order. By submitting the order, the Buyer confirms that they have read and agree to them.
2. Definitions
- Relicodes product — a stainless-steel plate with a unique QR code and the associated option to create a digital memorial profile.
- Plate — a physical product made of stainless steel, measuring 50 × 55 mm, intended for attachment to a suitable surface at a memorial site.
- Digital profile — an online page created to store photographs, videos, texts and other memorial information.
- Relicodes application — a mobile application used to manage the digital profile by the Buyer or another authorised person.
- Profile administrator — a person who has access to the application and may edit the content of the digital profile; the Buyer is the primary Profile administrator.
- Profile visitor — a person who scans the QR code and views the digital profile in a web browser.
- Consumer — a natural person who enters into a contract with the Seller outside the scope of their business activity or independent exercise of their profession.
- Digital service — a service consisting mainly of the operation of the application, the creation and provision of access to the digital profile, and technical hosting of content.
3. Order and conclusion of the contract
The Buyer orders the Relicodes product through the Relicodes.cz e-shop. Before submitting the order, the Buyer is obliged to check the entered information, in particular the contact details, delivery address, the selected product, the product price, the delivery price and the total order price.
By submitting the order, the Buyer makes a binding proposal to conclude a purchase contract. The purchase contract is concluded at the moment the Seller confirms acceptance of the order to the Buyer's e-mail address, unless expressly stated otherwise in a specific case. The confirmation of the order also includes these terms and conditions or a link to their current version.
The Seller reserves the right not to accept an order, in particular in the event of an obvious pricing error, unavailability of goods, suspicion of misuse of the service, incomplete or clearly incorrect information provided by the Buyer, or for another serious reason.
4. Price and payment terms
The price of the product is always stated on the e-shop next to the specific offer. The total price of the order is shown to the Buyer before it is submitted, including any delivery costs and other fees, if charged.
The Seller is not a VAT payer. If a price is stated on the e-shop, it is the final price charged to the customer, unless expressly stated otherwise.
Payment can be made using the payment methods available in the e-shop's ordering process. The e-shop may, in particular, enable card payments (Visa, Mastercard, American Express, Maestro, UnionPay) and digital wallets (Apple Pay, Google Pay) through the Shopify payment solution or related payment providers.
Goods are generally dispatched without undue delay after the order has been successfully paid, unless stated otherwise for a specific order or payment method. The Seller shall issue the Buyer with proof of purchase and send it electronically, or make it available through the e-shop or customer communication.
5. Delivery of goods
The Seller delivers goods to the address specified by the Buyer in the order. The usual delivery time is 2 to 3 business days from dispatch, provided the goods are in stock and there is no delay caused by the carrier, the payment provider, or force majeure.
Upon receipt of the goods, the Buyer is obliged to check that the packaging is intact and, in the event of obvious damage, to follow the carrier's instructions. We recommend notifying the Seller of any obvious damage to the shipment as soon as possible at info@relicodes.cz, so that the situation can be resolved quickly.
Upon receipt of the goods, the risk of accidental destruction, damage or loss of the goods passes to the Buyer, unless the law provides otherwise.
6. Activation of the digital profile and use of the application
After receiving the Relicodes product, the Buyer may activate the digital profile through the Relicodes application or another procedure described in the instructions. Activation usually consists of scanning the QR code, verifying authorisation, and entering basic profile information.
The Buyer acknowledges that responsibility for content uploaded to the digital profile lies with the person who uploaded it or who manages the profile. The Profile administrator is obliged to upload only content to which they have the necessary rights, consents or other legal grounds. This applies in particular to photographs, videos, texts, personal data of living persons and copyright-protected materials. The Seller bears no responsibility whatsoever for the content uploaded to the profile, including its accuracy or truthfulness, or any infringement of third-party rights.
The capacity of a single digital profile is limited to 500 MB of data. The limit applies in particular to photographs, videos and other files uploaded to the profile. The Seller may display the current capacity usage in the application, technically adjust the size of uploaded files, or refuse to upload a file if it would exceed the profile's capacity.
The Seller is entitled to restrict, hide or remove content that is clearly unlawful, offensive, hateful, pornographic, infringes the rights of third parties, disrupts the dignity of the deceased, or is otherwise contrary to the purpose of the Relicodes service.
Visitors to the memorial site may view the profile by simply scanning the QR code. To view the profile, visitors generally do not need to download the application; the profile opens in a web browser.
7. Hosting, maintenance and future annual fee
The Relicodes product includes a digital service consisting mainly of the technical operation of the profile, storage of content, access to the profile via the QR code, and basic system maintenance. The Seller makes reasonable efforts to ensure that digital profiles and the Relicodes application remain available, secure and functional.
The Buyer acknowledges that the long-term operation of digital profiles requires ongoing technical, hosting, security and maintenance costs. The Seller is therefore entitled to introduce, in the future, an annual hosting fee for the continued operation and maintenance of the digital profile, in particular for data storage, server operation, security, updates and technical administration of the service.
If an annual hosting fee is introduced, the Seller will inform the Profile administrator in advance at the available contact e-mail address or through the application. The information will include the amount of the fee, the period to which the fee relates, the method of payment, and the consequences of non-payment. Failure to pay the hosting fee may lead to restricted profile management, restricted public display of the profile, or archiving of the profile, but always only after reasonable notice to the Profile administrator.
The introduction of a hosting fee does not affect rights already acquired by the customer under a previously concluded purchase contract, where it was expressly stated for a specific product that a particular type of hosting is included in the price for a specific period. For new orders, the terms stated on the e-shop at the time of ordering shall apply.
8. Attaching the plate
The plate is intended for attachment to a suitable, clean, dry and degreased surface. The Buyer is obliged to follow the instructions supplied with the product. The Seller is not liable for damage caused by incorrect installation, attachment to an unsuitable surface, mechanical damage, vandalism, interference by a third party, or use contrary to the instructions.
The Buyer is also responsible for ensuring that the placement of the plate at a specific memorial site complies with the rules of the relevant cemetery, the grave lease agreement, the instructions of the cemetery administrator, and any consent required from other authorised persons.
9. Withdrawal from the contract by a consumer
If the Buyer is a consumer, they have the right, under Czech law, to withdraw from a contract concluded at a distance within 14 days of receiving the goods, unless the law provides for an exception.
The Buyer may send the withdrawal notice by e-mail to info@relicodes.cz or by post to BORÁK INDUSTRIES, s.r.o., Vlčnovská 2066, 688 01 Uherský Brod.
The following text may be used for withdrawal: "I hereby give notice that I am withdrawing from the contract for the purchase of the Relicodes product. I state the order number, first and last name, date of receipt of the goods and bank account number for the refund, if necessary." Use of this template is not mandatory.
In the event of withdrawal, the Buyer is obliged to send the goods back no later than 14 days from the withdrawal from the contract, to the address BORÁK INDUSTRIES, s.r.o., Vlčnovská 2066, 688 01 Uherský Brod. The Buyer bears the direct costs of returning the goods, unless the Seller expressly states otherwise.
The Seller shall refund the funds received by the Buyer no later than 14 days from the delivery of the withdrawal notice. However, the Seller is not obliged to refund the funds before receiving the returned goods, or before the Buyer proves that the goods have been sent back.
The Buyer is liable for any decrease in the value of the goods resulting from handling the goods in a manner other than what is necessary to become acquainted with their nature, characteristics and functionality. The full price can generally only be refunded for goods returned unused, undamaged, clean, complete and including accessories. If the plate has already been affixed, mechanically damaged, soiled, devalued, or is missing a part, the refunded amount may be reasonably reduced according to the extent of the decrease in value of the goods.
Exceptions to the right of withdrawal
The right of withdrawal cannot be exercised in particular for goods manufactured or adapted according to the Buyer's individual requirements, for goods that have, after delivery, been inseparably mixed or combined with other items, or for a digital service or digital content, where the statutory conditions for commencing performance before the expiry of the withdrawal period have been met and the Buyer has given express consent to this.
If the Buyer activates the digital profile, begins uploading content, or expressly requests the commencement of the digital service before the expiry of the 14-day withdrawal period, the right of withdrawal from the digital part of the service may be limited to the extent permitted by law.
10. Complaints, liability for defects and warranty
The Seller is liable to the Buyer for the goods being free of defects upon receipt and for corresponding to the description stated on the e-shop. For consumers, rights arising from defective performance are governed in particular by the Civil Code.
The physical Relicodes product carries a 2-year warranty, unless stated otherwise for a specific product. The warranty covers manufacturing defects and material defects. It does not cover normal wear and tear, incorrect installation, mechanical damage, vandalism, interference by a third party, use contrary to the instructions, or damage caused by extraordinary external influences.
A complaint may be submitted by e-mail to info@relicodes.cz. In the complaint, the Buyer should state the order number, a description of the defect, contact details and, if possible, attach photographs of the defect. The Seller will inform the Buyer of the further procedure.
A consumer's complaint will be handled without undue delay, no later than within the period stipulated by law. The Buyer will be informed of the outcome of the complaint by e-mail.
11. Availability of the digital service
The Seller makes reasonable efforts to ensure that digital profiles and the Relicodes application are available and functional. However, the Buyer acknowledges that availability may be temporarily limited due to maintenance, updates, server outages, force majeure, security measures, or issues on the part of technical infrastructure providers.
The Seller is entitled to technically modify, update and improve the application and digital profiles. Such changes must not unreasonably restrict the main purpose of the product, which is the preservation and accessibility of the memorial profile via the QR code.
12. Liability for profile content
The Profile administrator must not upload content to the digital profile that infringes legal regulations, third-party rights, copyright, personality rights, the right to privacy, or standards of decency. The Profile administrator is obliged to ensure that they have the authorisation to use all photographs, videos and texts they upload to the profile.
If a third party notifies the Seller of allegedly unlawful content, the Seller is entitled to temporarily hide the content or restrict its availability until the matter is resolved. This does not affect the Profile administrator's liability for uploaded content.
13. Out-of-court settlement of consumer disputes
In the event of a consumer dispute, the consumer has the right to contact the Czech Trade Inspection Authority, which is the body responsible for the out-of-court settlement of consumer disputes. More information is available at www.coi.cz.
The Buyer may also address a complaint directly to the Seller via e-mail at info@relicodes.cz. The Seller will endeavour to resolve any such matters quickly, fairly and in good faith.
14. Final provisions
These terms and conditions are governed by the law of the Czech Republic. This does not affect the rights of the consumer arising from mandatory legal provisions.
The Seller may unilaterally amend the terms and conditions. The terms and conditions and any amendments thereto take effect from the moment they are published on the Seller's website. The version of the terms and conditions in effect at the time the order is received shall apply to a specific order, unless the parties agree otherwise in writing. Contracts concluded before an amendment to the terms and conditions shall be governed by the terms and conditions in effect at that time.
